What happens if the driver who hit you has no insurance? Learn how UM/UIM coverage protects you from paying for someone else's negligence in Florida.
Protecting Yourself When the Other Driver Isn’t Insured
You’re driving through Miramar, minding your own business, when another vehicle runs a red light and hits you. You’re injured, your car is totaled, and you’re facing thousands of dollars in medical bills and lost wages. When the police arrive, you discover the terrifying truth: The driver who hit you has no insurance.
In many states, including Florida, this scenario is shockingly common. While Florida law requires drivers to carry Personal Injury Protection (PIP) and Property Damage Liability (PDL), Bodily Injury Liability (BIL)—which covers your injuries caused by someone else—is not mandatory.
This is where Uninsured/Underinsured Motorist (UM/UIM) Coverage becomes your most vital protection.
What is UM/UIM Coverage?
UM/UIM is an optional coverage add-on to your own auto insurance policy. It is designed to act as a safety net, stepping into the shoes of the at-fault driver if they either:
- Have no insurance (Uninsured Motorist).
- Do not have enough insurance to cover the full extent of your damages (Underinsured Motorist).
How UM Protects You from a "Hit and Run"
A hit-and-run accident is treated the same as an accident with an uninsured driver. If you are the victim of a hit-and-run, your UM coverage is often the only pathway to recover compensation for non-economic damages like pain and suffering. Without it, you are limited to your $10,000 PIP benefit, which barely covers emergency room costs.
Underinsured Motorist: When Minimum Limits Aren’t Enough
Even if the at-fault driver has basic BIL coverage (e.g., $10,000/$20,000 limits), a serious injury can easily exhaust those funds in days. If your medical bills are $50,000, that driver’s insurance will only pay $10,000. Your UIM coverage would then cover the remaining $40,000 difference, up to your own policy limit.
Don't Wait Until It's Too Late
We frequently see accident victims who are surprised to learn that their "full coverage" policy does not include UM protection. Insurance agents often emphasize lower premiums by omitting it.
We strongly advise all Florida drivers to review their policy immediately. If you don't have UM/UIM coverage, add it. It is one of the least expensive ways to buy peace of mind and protect your financial future.
